Category "F" Claims


Category "F" claims are claims filed by Governments and international organizations for losses incurred in evacuating citizens; providing relief to citizens; damage to diplomatic premises and loss of, and damage to, other government property; and damage to the environment. The Commission has received approximately 300 category "F" claims, submitted by forty-three Governments and six international organisations, seeking a total of approximately US$210 billion in compensation. The category "F" claims have been organised into four subcategories. In addition, the "E/F" category covers export guarantee and insurance claims.


 

The number of category "F" claims filed by claimant Governments. 


The Commission has organized the category "F" claims into four main sub-categories and established for each a corresponding secretariat team and panel of Commissioners. A sub-category of mixed "E/F" claims has also been identified. 

"F1" claims are for losses incurred in connection with the departure and evacuation of individuals and for damage to property belonging to Governments and to international organizations. The Commission has received approximately 100 "F1" claims seeking a total of approximately US$30 billion in compensation. 

"F2" claims are claims filed by the Governments of Jordan and Saudi Arabia. The Commission has received approximately 75 "F2" claims seeking a total of over US$20 billion in compensation. 

"F3" claims are claims filed by the Government of Kuwait, excluding environmental claims. The Commission has received approximately 60 "F3" claims submitted on behalf of Kuwaiti ministries and other government entities seeking a total of approximately US$120 billion in compensation. Most of the "F3" claims include multiple types of loss, such as damage to government buildings, loss of equipment, loss of the value of work carried out by contractors prior to the invasion and relief provided to the Kuwaiti population. 

"F4" claims are claims for damage to the environment. The Commission has received approximately 170 such claims seeking a total of approximately US$80 billion in compensation. "F4" claims fall into two broad groups. The first group comprises claims for environmental damage and the depletion of natural resources in the Persian Gulf region including those resulting from oil-well fires and the discharge of oil into the sea. The second group consists of claims for costs incurred by Governments outside of the region in providing assistance to countries that were directly affected by the environmental damage. This assistance included the alleviation of the damage caused by the oil-well fires, the prevention and clean up of pollution and the provision of manpower and supplies.

"E/F" claims are export guarantee and insurance claims submitted under both categories "E" and "F". Approximately 137 "E/F" claims have been filed with the Commission with a total asserted value of approximately US$6 billion. Each export guarantee or insurance claim normally covers a number of corporate claims, the compensability of which must first be established in order to verify the guarantee claim. 

The review of all category "F" claims by the panels of commissioners has been completed, with the exception of claims in category "F4".
